Living Statues as Art

Okay so I know, I have a thing for interation in my public art. Getting another freebee and I'd be crazy not to put this on here. Now-

Is this Public Art?

I believe so. When have we not classified a statue as "Art'. Better yet, when placed out oin the open in front of the eyes of the public, why not 'public art'. The art is not only in the 'statue' itself, but the suprise that comes from the unsuspecting, as well as the amusement on the aware.
